Terms of Use

These Terms of Use govern the use of the Vile za odmor Hrvatska platform at vilezaodmor.com.hr. The platform is operated by MCODE, obrt za računalno programiranje, VAT/OIB 58358056658, D. Cesarića 67, 31550 Valpovo. Contact: hello@mcode.hr.

What the service is. Vile za odmor Hrvatska is an accommodation directory and an intermediary for enquiries. We publish owners’ listings and forward guests’ enquiries to them. We are not a party to the relationship between guest and owner, we charge no commission on bookings, and we do not process payment for the stay.

Users. The platform is used by guests, who browse listings and send enquiries without an account, and by owners, who open an account in order to list a property. An account may be opened by an adult with legal capacity, in their own name or on behalf of a legal entity they are authorised to represent.

Owner accounts. The owner must provide accurate information and keep it up to date, keep their credentials safe and not share them. The owner is responsible for all content they publish and for everything done from their account.

Owner obligations. The owner warrants that they are entitled to rent out the property they advertise and that they meet the obligations imposed by Croatian law — among them the permit for providing accommodation services, guest registration and tax obligations. They further warrant that the listing, including prices and availability, is accurate and that confirmed bookings will be honoured.

Membership. Membership is currently free. If we introduce a fee, we will announce it in advance and no amount will be charged without explicit acceptance. Membership provides a published listing on the platform and access and posting rights in the Facebook group Vile za odmor, subject to administrator approval.

Booking enquiries. We forward a guest’s enquiry to the owner. The accommodation contract is concluded directly between guest and owner, on the terms they agree. The platform does not guarantee availability or that a contract will be concluded.

It is prohibited to publish inaccurate or misleading listings, third-party content without the right to use it, or a property that is not genuinely available, and to harvest data from the platform automatically or load it in a way that endangers its operation.

Content and copyright. The owner retains rights in the photographs and texts they publish and warrants that they may use them. By publishing, they grant us a non-exclusive right to display that content on the platform and in the channels through which we present it, for as long as the listing is published.

Liability. Listings are published by owners and we do not verify every detail in them. We are not liable for the accuracy of listings, the quality of the accommodation, or performance of the contract between guest and owner. We are liable for damage caused intentionally or by gross negligence; liability for uninterrupted availability of the platform is excluded to the extent permitted by law.

Termination. The owner may stop using the platform at any time and request deletion of their account. We may suspend or remove a listing and an account in the event of a breach of these Terms or of the law, with notice to the owner’s email address.

Changes to the Terms. We may amend these Terms. Every version carries a label and a date, and material changes are announced by email before they take effect. Continued use after they take effect constitutes acceptance.

Governing law and disputes. Croatian law applies. We seek to resolve disputes by agreement; failing that, the competent court at the operator’s seat has jurisdiction. Consumers may also use the European online dispute resolution platform at ec.europa.eu/consumers/odr.
